Pickleball At Sea Group Cruise (“we,” “us,” or “our”) provides curated travel experiences that combine Pickleball programming, instruction, and cruise vacations (the “Services”). These Terms of Service (“Terms”) govern your use of our website, booking platform, and participation in any Pickleball At Sea Group Cruise experience.

By accessing our website, making a reservation, or participating in our Services, you agree to be bound by these Terms.

1. Eligibility

By using our Services, you confirm that you are at least 18 years old or the age of majority in your jurisdiction and have the legal authority to enter into this agreement on behalf of yourself and any Guests included in your reservation. You agree to be responsible for all Guests included in your booking. By completing your purchase and submitting payment, you confirm that you have read, understand, and agree to these Terms, along with our Privacy Policy, Refund Policy, and Assumption of Risk & Liability Waiver.

2. Nature of Services

Pickleball At Sea Group Cruise provides Pickleball programming, instruction, and hosted group experiences, along with coordination of group travel experiences. We are not a cruise line, airline, hotel, or transportation provider, and we are not owned, operated, or controlled by any cruise line. We work with third-party providers including, but not limited to, cruise lines such as Royal Caribbean International, travel providers such as Escape Group Cruises, hotels, transportation providers, and excursion partners. These third parties operate independently and are responsible for their own services, policies, and operations.

3. Use of Third-Party Trademarks

All third-party company names, brand names, trademarks, and ship names referenced in connection with our Services, including but not limited to Royal Caribbean International and its vessels, are the property of their respective owners. Such references are used for descriptive purposes only. Pickleball At Sea Group Cruise is an independent entity and is not affiliated with, endorsed by, or sponsored by any cruise line or third-party provider unless explicitly stated.

4. Booking Structure and Payments

Your Pickleball Experience reservation may include payments to multiple entities. Your reservation with Pickleball At Sea Group Cruise applies only to the Pickleball Experience and is separate from your cruise line reservation. Payments made directly to Pickleball At Sea Group Cruise are for the Pickleball Experience, programming, planning, coordination, and related services. You acknowledge that services begin immediately upon payment, including administrative work, planning, coordination, and reservation-related services. Payments for your cruise vacation, including stateroom deposits and cruise fare, are processed directly with the cruise line through our travel provider and are subject to the cruise line’s terms and conditions. All payments made directly to Pickleball At Sea Group Cruise are non-refundable and non-cancellable, as outlined in our Refund Policy.

5. Refund Policy

All payments made directly to Pickleball At Sea Group Cruise are non-refundable and non-cancellable. Due to the nature of our Services, including advance planning, coordination, and limited-capacity experiences, no refunds will be issued for any reason, including but not limited to schedule changes, personal conflicts, travel disruptions, missed departures, dissatisfaction with the experience, or failure to participate in any portion of the Services. No refunds, credits, or adjustments will be provided for missed activities, late arrivals, early departures, or voluntary non-participation. Payments made to third-party providers, including cruise lines, hotels, and transportation providers, are subject to their respective policies. Travel insurance is strongly recommended. 6. Assumption of Risk & Participation

Participation in Pickleball activities and related experiences is voluntary and involves inherent risks, including physical injury, illness, travel-related risks, and other unforeseen circumstances. By participating, you acknowledge and accept these risks. You represent that you are physically able to participate, will follow all instructions, and understand that additional waivers may be required by us or third-party providers. Pickleball programming, including group assignments, court time, and instruction, is organized at our discretion based on skill level, participation, and operational considerations. No minimum amount of playtime, instruction, or specific grouping is guaranteed.

7. Health & Medical Responsibility

You acknowledge that you are responsible for ensuring you are medically and physically fit to participate in all activities. Pickleball At Sea Group Cruise is not responsible for providing medical care or for any medical expenses incurred during or after participation in the Services. You are solely responsible for obtaining any necessary medical treatment and for all associated costs.

8. Third-Party Responsibility Disclaimer

Pickleball At Sea Group Cruise is not responsible for the acts, errors, omissions, delays, or performance of any third-party provider. This includes, but is not limited to, cruise lines, hotels, transportation providers, excursion operators, and facility partners. We are not liable for cancellations, delays, schedule changes, service disruptions, or failures caused by third-party providers.

9. Cruise Line Terms Supremacy

All cruise-related services, including but not limited to transportation, accommodations, onboard policies, and itinerary changes, are governed by the terms and conditions of the applicable cruise line. In the event of any conflict between these Terms and the cruise line’s terms, the cruise line’s terms shall control with respect to those services.

10. Pricing and Availability

Pricing is subject to availability and may change at any time until payment is made in full. Pricing and availability are not guaranteed until full payment has been received and confirmed. We reserve the right to modify pricing, correct errors, or adjust reservations as necessary.

11. Service Modifications

We reserve the right to modify, substitute, or cancel any aspect of the Services, including but not limited to programming, instructors, schedules, court availability, locations, and activities. Pickleball schedules, court time, instructors, and locations are subject to change at any time. Programming conducted ashore is dependent on port access, local conditions, and third-party availability. If a port is missed, delayed, or modified for any reason, associated Pickleball activities may be adjusted or unavailable. We may substitute programming, facilities, or instructors with comparable alternatives when necessary. Such changes do not constitute grounds for a refund.

12. No Guarantee of Experience

We do not guarantee specific outcomes, results, or experiences. You acknowledge that group size, skill levels, playtime, weather conditions, sea conditions, court availability, and overall experience may vary. No minimum amount of playtime, instruction, or specific grouping is guaranteed.

13. Instructor & Programming Disclaimer

We do not guarantee the participation of any specific instructor, coach, or featured guest. Instructors and programming are subject to change at any time without notice.

14. Facilities & Transportation

Access to specific facilities, courts, or locations is not guaranteed and may be subject to change. Transportation delays, operational issues, weather conditions, sea conditions, or third-party disruptions may impact scheduled activities. Missed or modified sessions due to these factors do not constitute grounds for a refund.

15. Travel Responsibility

Guests are solely responsible for arranging and managing their travel to and from the cruise, including flights, transfers, accommodations, and arrival timing. Pickleball At Sea Group Cruise is not responsible for missed departures, delays, or travel disruptions that impact participation in any portion of the experience, including pre-cruise or Day 0 offerings.

16. Guest Communication & Responsiveness

Guests are responsible for providing accurate contact information and for monitoring their email, phone, and messages for communications related to their Pickleball Experience reservation. In certain situations, timely communication may be required to finalize reservation details, confirm participation, or complete required steps. If a Guest fails to respond to repeated reasonable attempts of contact within a reasonable period of time, Pickleball At Sea Group Cruise reserves the right to proceed with available information, modify the reservation as necessary, or release or cancel the Pickleball Experience reservation. In such cases, all payments made shall remain non-refundable.

17. Minimum Participation Requirement

Certain Pickleball At Sea Group Cruise experiences may require a minimum number of participating Guests to operate as planned. In the event that minimum participation levels are not met, we reserve the right to modify, adjust, or cancel specific programming, instructors, or elements of the experience. Pickleball At Sea Group Cruise reserves the right to cancel or modify the Pickleball Experience in its entirety if necessary. Any compensation, if offered, will be at the sole discretion of Pickleball At Sea Group Cruise.

18. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our control, including but not limited to weather conditions, sea conditions, travel disruptions, government actions, port changes, or supplier issues. Cruise itineraries are subject to change at the discretion of the cruise line.

19. Communications

By providing your contact information, you consent to receive emails, phone calls, and text messages related to your reservation. You acknowledge that your information may be shared with relevant third-party providers, including cruise lines and travel partners, as necessary to fulfill your reservation and deliver the Services.

20. Photography and Media

You grant us the right to use your image and likeness for marketing and promotional purposes.

21. Guest Conduct

We reserve the right to remove any Guest from participation without refund for unsafe, disruptive, or inappropriate behavior. Guests are responsible for their behavior at all times, including behavior related to alcohol consumption. We are not responsible for any incidents, injuries, damages, or disruptions resulting from a Guest’s actions.

22. Personal Property

We are not responsible for lost, stolen, or damaged personal property.

23. Accuracy of Information

You are responsible for providing accurate information. We are not responsible for errors resulting from incorrect information.

24. Errors and Omissions

We reserve the right to correct errors, inaccuracies, or omissions and to cancel or update reservations as needed.

25. Right to Refuse Service

We reserve the right to refuse service to anyone at any time.

26. Transfer & Resale Policy

Pickleball Experience reservations are non-transferable and may not be resold without our prior written consent.

27. Chargebacks and Payment Disputes

You agree to contact us and allow a reasonable opportunity to resolve any issue prior to initiating a chargeback or payment dispute. By agreeing to these Terms, you acknowledge that all payments made directly to Pickleball At Sea Group Cruise are valid and non-refundable. Initiating a chargeback for a valid charge may be considered a breach of these Terms, and you may be responsible for any fees, costs, or expenses incurred as a result.

28. Independent Contractor Status

All instructors, coaches, hosts, and representatives engaged in connection with the Services are independent contractors unless otherwise stated. Nothing in these Terms shall be construed to create any partnership, joint venture, or employment relationship.

29. Disclaimer of Warranties

Services are provided “as is” without warranties of any kind.

30. Limitation of Liability

Our liability is limited to the amount paid directly to Pickleball At Sea Group Cruise.

31. Indemnification

You agree to indemnify and hold harmless Pickleball At Sea Group Cruise from any claims arising from your participation.

32. Governing Law

These Terms are governed by the laws of the State of Florida, with venue exclusively in Lee County, Florida.

33. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

34. Entire Agreement

These Terms, along with the Privacy Policy, Refund Policy, and Assumption of Risk & Liability Waiver, constitute the full agreement. In the event of any conflict, these Terms of Service shall control unless otherwise explicitly stated.

35. Changes to Terms of Service

We reserve the right, at our sole discretion, to update, modify, or replace any part of these Terms at any time. Continued use of our Services constitutes acceptance of any such changes.
