Pickleball At Sea Group Cruise (“we,” “us,” or “our”) provides curated travel experiences that include Pickleball instruction, organized activities, and group travel aboard cruise ships and at various onshore locations.

By participating in any Pickleball At Sea Group Cruise experience, you (“Guest”) acknowledge and agree to the following:

1. Voluntary Participation

I understand that participation in all activities offered by Pickleball At Sea Group Cruise is voluntary. I choose to participate at my own discretion and accept full responsibility for my involvement.

2. Scope of Activities

This Waiver applies to all activities associated with Pickleball At Sea Group Cruise, including but not limited to Pickleball play, instruction, drills, tournaments, transportation, excursions, social events, use of facilities, and all related travel activities both onboard and ashore.

3. Assumption of Risk

I understand that participation in activities and travel experiences involves inherent risks. I understand that Pickleball is a physically active sport involving quick movements, changes in direction, and repetitive motion, which may increase the risk of injury.

I understand that these risks include, but are not limited to, physical injury, including serious injury, disability, or death, slips, falls, collisions, overexertion, equipment-related injuries, weather-related conditions, travel-related risks, including transportation delays or incidents, and exposure to illness or communicable diseases.

I knowingly and voluntarily assume all risks, whether known or unknown, anticipated or unanticipated, associated with my participation.

4. Travel and Foreign Risk Acknowledgment

I understand that travel, including international travel, involves additional risks, including unfamiliar environments, local laws, varying safety standards, and limited access to medical care. I voluntarily assume all such risks.

5. Physical Fitness and Health

I certify that I am physically able to participate in activities. I understand that it is my responsibility to consult a physician if I have any medical concerns, monitor my own physical condition, and stop participation if I feel unwell or unsafe.

I understand that participation may occur in group or open-play environments and that I am responsible for my own safety and awareness during all activities.

I acknowledge that Pickleball At Sea Group Cruise does not provide medical advice or supervision.

6. Release of Liability

To the fullest extent permitted by law, I release, waive, and discharge Pickleball At Sea Group Cruise, its owners, officers, employees, contractors, instructors, affiliates, partners, and representatives from any and all claims, liabilities, damages, or causes of action arising out of or related to my participation, including claims arising from the negligence of Pickleball At Sea Group Cruise, to the fullest extent permitted by law.

This release is intended to be as broad and inclusive as permitted by applicable law and applies to all claims, whether known or unknown, anticipated or unanticipated.

7. Third-Party Providers

I understand that Pickleball At Sea Group Cruise partners with third-party providers, including but not limited to cruise lines (such as Royal Caribbean), travel providers (such as Escape Group Cruises), hotels, transportation providers, and excursion operators.

I acknowledge that these providers operate independently and that Pickleball At Sea Group Cruise is not responsible for their acts, omissions, or performance.

8. Interaction with Other Guests

I understand that I may interact with other participants during the experience and agree that Pickleball At Sea Group Cruise is not responsible for the actions, behavior, or conduct of other Guests.

9. Photography and Media Release

I acknowledge that photos and videos may be taken during my participation.

I grant Pickleball At Sea Group Cruise the unrestricted right to use my likeness, image, voice, and appearance in any photos or videos for marketing, promotional, and commercial purposes without compensation.

10. Guest Conduct

I agree to conduct myself in a respectful and safe manner at all times.

I understand that Pickleball At Sea Group Cruise reserves the right to remove me from participation, without refund, for behavior that is disruptive, unsafe, illegal, or negatively impacts other Guests or staff.

11. Personal Property

I understand that I am solely responsible for my personal belongings and that Pickleball At Sea Group Cruise is not responsible for any lost, stolen, or damaged items.

12. Emergency Medical Treatment

I authorize Pickleball At Sea Group Cruise and its representatives to obtain emergency medical treatment on my behalf if necessary.

I understand that I am responsible for any costs associated with such treatment.

13. Indemnification

I agree to indemnify and hold harmless Pickleball At Sea Group Cruise and its affiliates from any claims, damages, or expenses arising out of my participation, including claims brought by third parties.

14. Responsibility for Additional Guests

If I am making a reservation on behalf of other Guests, I represent that I have the authority to agree to this Waiver on their behalf and that all Guests have been informed of and agree to these terms.

15. Electronic Acceptance

I agree that checking a box, signing electronically, or otherwise accepting this Waiver constitutes a legally binding signature.

16. Severability

If any provision of this Waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

17. Governing Law

This Waiver shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in Lee County, Florida.

18. Acknowledgment and Agreement

By agreeing to this Assumption of Risk & Liability Waiver, I acknowledge that I have read and fully understand this document, I understand that I am giving up substantial legal rights, I have had the opportunity to ask questions, and I am agreeing voluntarily and without any inducement.

This agreement is binding upon me, my heirs, assigns, and legal representatives.

I further acknowledge that by completing my purchase and submitting payment, I am confirming my agreement to this Waiver.
